The short version: Use Cue to run your events and communicate with your attendees. Don't abuse the platform or spam people. SMS messages are only sent to attendees who explicitly opt in. You can opt out any time by replying STOP.

Overview

These Terms & Conditions ("Terms") govern your use of Cue Labs LLC ("Cue," "we," "us"), a platform for event organizers to manage ticketing, customer data, and marketing communications. By accessing or using Cue, you agree to these Terms.

Cue is operated by Cue Labs LLC If you do not agree to these Terms, do not use the platform.

SMS Program

Program name: Cue Labs LLC SMS Marketing

Description: Event organizers using Cue may send promotional SMS messages to attendees about upcoming events, ticket availability, and event reminders. Messages are sent only to attendees who have explicitly opted in to receive SMS communications from a specific organizer.

Message frequency: Message frequency varies by organizer. You may receive up to 4 messages per month per organizer you have opted in with, though the actual frequency may be lower.

Message and data rates: Message and data rates may apply. Check with your mobile carrier for details.

Consent: By checking the SMS opt-in box at checkout or on a sign-up form, you consent to receive SMS marketing messages from that event organizer via Cue. Consent is never a condition of purchasing a ticket or attending an event.

Opt-Out & Help

You can cancel SMS messages at any time. To stop receiving messages from an organizer, reply STOP to any message you receive. You will receive a one-time confirmation that you have been unsubscribed. No further messages will be sent from that organizer unless you opt in again.

Supported carriers include AT&T, Verizon, T-Mobile, Sprint, and most major US carriers. Carrier support is not guaranteed for all carriers.

Accounts

To use Cue as an organizer, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must be at least 18 years old to create an organizer account. You must be at least 13 years old to purchase tickets or otherwise use the platform as an attendee. We do not knowingly collect personal data from anyone under 13.

Notify us immediately at info@cueup.co if you believe your account has been compromised.

Your Responsibilities

By using Cue, you agree not to:

  • Send SMS messages to people who have not opted in
  • Use the platform to send spam, unsolicited messages, or misleading communications
  • Upload CSV data that includes personal information you are not authorized to process
  • Attempt to circumvent security measures or access data belonging to other organizations
  • Use the platform in any way that violates applicable law, including TCPA, CAN-SPAM, or any state privacy laws
  • Impersonate another person or organization

Organizers are responsible for ensuring they have appropriate consent from attendees before sending any SMS or email marketing communications.

Intellectual Property

Cue Labs LLC retains all rights to the Cue platform, software, design, and branding. Nothing in these Terms transfers any intellectual property rights to you.

You retain ownership of the event data, customer data, and content you upload to Cue. By uploading content, you grant Cue Labs LLC a limited license to store, process, and display that content solely to provide the service to you.

You may not copy, modify, distribute, sell, or lease any part of the Cue platform without written permission from Cue Labs LLC

Disclaimers

Cue is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

We are not responsible for the content of SMS messages sent by organizers, the accuracy of event information, or any disputes between organizers and attendees.

Payment processing is handled by Stripe. We are not responsible for payment failures, chargebacks, or errors arising from Stripe's systems.

Limitation of Liability

To the maximum extent permitted by law, Cue Labs LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform.

Our total liability to you for any claim arising out of or related to these Terms or your use of Cue shall not exceed the amount you paid to Cue Labs LLC in the 12 months preceding the claim, or $100, whichever is greater.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email or with a notice inside the app at least 14 days before the change takes effect.

Continued use of Cue after a change takes effect constitutes acceptance of the updated Terms.
